Summary of the Home Office consultation response, “A Fairer Pathway to Settlement” (CP 1707, November 2026). Prepared 2 November 2026. This is a summary only; the operative text will be the Immigration Rules and the Statement of Changes.
At a glance
- The standard qualifying period for settlement rises from 5 to 10 years, with faster and slower pathways based on character, contribution, integration and residence.
- The consultation received 204,667 responses. The final model is described as simpler, with more recognition of family unity and targeted transitional protections.
- The proposed 15-year pathway for workers below RQF 6 is dropped. They go on the 10-year route.
- No general implementation date is given. Further guidance, safeguards and a full impact assessment are promised before implementation.
Mandatory requirements (all pathways)
- Good character and suitability, with no criminal record (see below).
- No outstanding government debt: NHS, tax, National Insurance and Home Office litigation debt.
- B2 English (up from B1). C1 gives no reduction in the qualifying period.
- Pass the Life in the UK test (under review).
- Sustained economic contribution.
- Exemptions continue for under-18s, people aged 65 or over, and those unable to comply because of a physical or mental condition.
- These requirements cannot be offset by higher earnings or other contributions.
Pathways
| Pathway | Who it is for | Earnings or basis |
| 3 years | Exceptional economic contribution | £125,141 in 3 of the last 4 years, or the highest talent group (subject to MAC review) |
| 5 years | Strong contribution | £50,271 in 3 of the last 5 years; eligible health and education public service roles (Annex C); or a recognised British connection |
| 10 years | Default | £12,571 in 5 of the last 7 years |
| 20 years | Non-compliance or reliance on public funds | £12,571 in 5 of the last 7 years, plus all mandatory requirements |
- Earnings thresholds are tied to the income tax and NIC thresholds and will move with them.
- The 3, 5 and 10-year pathways require no specified public funds in the 5 years before applying. Otherwise the pathway is 20 years.
- A qualifying immigration breach as an adult puts the applicant on the 20-year pathway.
- Volunteering will not shorten the qualifying period.
- The document describes the minimum contribution as three years in one place and 5 of 7 years on the 10-year path in another, so check the draft Rules for how this is reconciled.
Character
- Any adult UK criminal record leads to refusal. This includes custodial and suspended sentences, fines, community sentences, conditional cautions, and absolute or conditional discharges.
- Overseas convictions count where the conduct would be an offence in the UK, with some discretion.
- Discretion remains for offences committed under 18.
- Qualifying immigration breaches include overstaying, breaching conditions, deception, and frustrating immigration controls.
Residence
- The Long Residence route closes.
- Time on temporary routes no longer counts. These include Visit, Student, Graduate and High Potential Individual, Global Business Mobility, Temporary Worker, Youth Mobility, Seasonal Worker, Overseas Domestic Worker, and the Ukraine schemes.
- Time on leave outside the rules is also excluded, though the government says it will set out its approach to this cohort in due course.
- Protection and human-rights time cannot be combined with work or family time. The clock restarts on a move.
- Not every route qualifies for every pathway. For example, Family and Private Life leave does not qualify for the 3 or 5-year pathways.
Dependants
- A partner arriving with the main applicant can settle at the same time.
- A partner who joins later completes the same qualifying period.
- Couples can combine earnings to meet a £25,142 household income threshold.
- Children under 18 are exempt from the income, debt, English and Life in the UK requirements but remain subject to suitability and criminality.
- Dependants aged 18 to 24 settle with the family and must meet the adult mandatory requirements, but not the individual earnings test.
- At 25, a dependant must qualify independently or move onto an appropriate route.
Refugees
| Route | Pathway |
| Safe and Legal routes (including the UK Resettlement Scheme) | 5 years; A2 English for UK Resettlement Scheme refugees |
| Protection Work and Study | 10 years on that route |
| Core Protection | 20 years |
| Illegal entry | Additional 10 years (20 or 30 years in total) |
- The additional 10 years does not apply where Article 31 of the Refugee Convention protects the individual.
- Those who claimed asylum before 2 March 2026 move to Core Protection, and time with refugee status counts.
- Refugees on Core Protection and Protection Work and Study need B2 English.
Groups outside or protected from the framework
- Existing government commitments: Hong Kong BN(O) (5 years), Afghan schemes, legacy Safe and Legal routes (5 years), and Windrush.
- Armed forces: service personnel after at least 4 years’ reckonable service.
- Vulnerable groups, existing arrangements retained: bereaved partners, victims of domestic abuse, unaccompanied asylum-seeking children, children in care, and children and young adults who grew up in the UK.
- Separate or closed arrangements: EUSS, Turkish ECAA, Tier 1 (Investor), pre-2012 Overseas Domestic Worker, and the Calais and Section 67 routes.
- These groups still need to meet the strengthened criminality and English requirements unless an exemption applies.
Transitional arrangements
| Cohort | Outcome |
| Care workers who entered or switched before May 2025 | Keep the 5-year route if they meet the £25,000 salary, sponsorship and employment requirements |
| Care workers who fall short after 5 years | A further 5-year Health and Care visa, restricted to genuine sector work, with no recourse to public funds |
| Care workers whose sponsor licence is revoked | From 1 February 2027: 120 days to secure a job offer, plus 60 days to resolve status, or the visa is curtailed |
| Care workers entering or switching after May 2025 | Standard 10-year pathway |
| Health and education workers below RQF 6 on national pay scales who arrived before May 2025 | One-off 5-year route |
| Skilled Workers in the pre-April 2024 cohort | Can extend visas on current terms until 2035 |
Numbers
- The Home Office forecasts 1.3 million to 2.2 million settlements between 2026 and 2030, with a central estimate of 1.9 million.
- Over 500,000 people will become eligible later than they would have under current arrangements.
- Care worker cohort: 196,000 care workers and 186,000 dependants are in scope. The Home Office indicatively estimates around 146,000 care workers and 136,000 dependants could qualify under the transitional 5-year arrangement.
Points to watch
- Detailed guidance on public funds, vulnerable groups, refugee safeguards and Article 31 is still to come.
- Implementation timing is not stated, so current rules remain in force until a Statement of Changes is laid.
- Leave outside the rules and the treatment of the highest talent group remain open.
