Fiancé Visa

To be eligible to apply on this route on the basis of accompanying or joining a parent, the child would have to show one of the following:

 

  • both parents are present and settled here; or are being admitted for settlement on the same occasion;
  • one parent is present and settled in the United Kingdom and the other is being admitted on the same occasion for settlement during the period that the child is seeking entry; or
  • one parent is present and settled in the United Kingdom or being admitted on the same occasion for settlement and the other parent is deceased; or
  • one parent is present and settled in the United Kingdom or being admitted on the same occasion for settlement and has had sole responsibility for the child’s upbringing;
  • one parent or a relative is present and settled in the United Kingdom or being admitted on the same occasion for settlement and there are serious and compelling family or other considerations which make exclusion of the child undesirable and suitable arrangements have been made for the child’s care.


It is important that the child is under 18 at the time of the application ensuring that the child is not married, is not in a civil partnership and is not leading an independent life. The parents must ensure that there is adequate maintenance and accommodation for the child without having recourse to public funds. 

 

Adequate maintenance means that after income tax, National Insurance contributions and housing costs have been deducted, there must be available to the family the level of income that would be available to them if the family was in receipt of Income Support.
