自英國政府於 2021 年推出 BNO（British National (Overseas)）簽證計劃以來，已有超過數十萬港人透過此途徑移居英國，希望最終取得永久居留權（Indefinite Leave to Remain，簡稱 ILR）及英國國籍。 不少人以為只要持有 BNO 簽證並在英國居住滿五年，便能自動獲得永居資格。然而，實際情況並非如此。 每年都有申請人因忽略相關規定而導致申請延誤，甚至需要重新計算五年的居住期限。 以下是 BNO 持有人最常見的三大陷阱。 陷阱一：離境時間超過規定 這是最常見、亦是最容易被忽略的問題。 根據英國移民規定，BNO 持有人申請 ILR 時，必須符合「持續居住（Continuous Residence）」要求。在大多數情況下，申請人在任何連續 12 個月期間內，離開英國的總天數不得超過 180 天。 許多人誤以為只要每年不超過 180 天便可以，但實際上英國政府採用的是「滾動式 12 個月計算方法」（Rolling 12-Month Period），而非按曆年計算。 例如： 部分家庭因長時間回港照顧親人、工作外派、陪伴子女升學或頻繁旅行，而不知不覺超出限制。 一旦超過規定，五年的永居計時器有機會被重置，需要重新累積居住年期。 建議做法 陷阱二：簽證中斷或未及時續簽 另一個常見問題是簽證出現空窗期。 部分 BNO 持有人申請的是 2.5 年簽證，而非 5 年簽證。因此在簽證到期前，必須及時提交續簽申請。 如果出現以下情況： 都有可能影響「合法居留（Lawful Residence）」要求，進而影響 ILR 申請資格。 雖然部分情況可透過法律途徑補救，但程序往往複雜且成本高昂。 建議做法
