The UK Government’s new Command Paper, A Fairer Pathway to Settlement, sets out major proposed reforms to the settlement (ILR) system. However, the paper specifically states that spouses and dependants of British citizens, as well as dependants under the BN(O) route, are not included in this consultation.
This means that, for now, your existing settlement routes remain unchanged. The standard timelines continue to apply, that being on the 5-year route – eligible to apply for ILR as early as 28 days before completing 5 years of continuous residence.
Although you are not part of the current consultation, immigration policy can evolve quickly. To avoid any unforeseen changes in the future, we strongly advise you to apply for settlement at the earliest possible date once you are within the permitted 28-day window. This ensures you secure ILR under the rules currently in place and protects your long-term residence pathway.
