As previously discussed in our previous news, from 1 January 2021 onwards, the UK will be introducing a new immigration system that applies equally to EU and non-EU citizens. We now have further information on how the new immigration system will look like.
Applications for the new immigration routes will open in autumn 2020.
There are 4 main routes:
- Skilled workers
- Global talent scheme
- International students and graduates
- Current Tier 5 & Tier 1 visas
Skilled Workers
Skilled workers who have a job offer from an approved employer will need to demonstrate the following:
- The job offered is at a skill level of RQF3 (equivalent to A level) or above
- The skilled worker can speak English
- The skilled worker will receive a minimum salary
In terms of the minimum salary, the general threshold is £25,600. A skilled worker can still qualify for this route if they earn less than £25,600 but more than £20,480 if they can show that they meet other characteristics (e.g. the job offer is in a shortage occupation or they have a relevant PhD).
Employers looking to employ skilled migrants will have to apply to become an approved sponsor.
For those who do not meet the requirements for this route, there is no other specific route available.
Global Talent Scheme
This new scheme aims to attract scientists, researchers and mathematicians and opened recently on 20 February 2020.
Individuals under this scheme will not be required to enter the UK with a job offer.
This scheme will be opened to EU, EEA and Swiss citizens.
International Students and Graduates
Individuals will be able to apply for a visa to study in the UK if they can demonstrate that they:
- Have been offered a place on a course
- Can speak, read, write and understand English
- Have enough money to support themselves and pay for their course
From summer 2021, a new graduate immigration route will be available to international students who have completed a degree in the UK. This allows graduates to work, or look for work in the UK for up to 2 years.
Student visa routes will be opened to EU, EEA and Swiss citizens.
Tier 5 and Tier 1 Visas
Current Tier 5 (short-term work visas in specific sectors) and Tier 1 (business development and talent visas) will be opened to EU citizens.
Visiting the UK
EU, EEA and Swiss citizens and other non-visa nationals will not require a visa to enter the UK when visiting the UK for up to 6 months.
EU Citizens living in the UK
EU, EEA and Swiss citizens living in the UK before 31 December 2020 can apply to the EU Settlement Scheme to continue living in the UK after 30 June 2021.
What’s next?
With the COVID outbreak, we envisage that there will be a prolonged effect on UK immigration but nevertheless, no is not the time to pause. We strongly advise companies wishing to hire in the future to start looking into applying for a Sponsor License and equip themselves with the right tools to ensure continuity in their workforce.
